A1 Certificate from Romania: Legal Framework, Posting and Pluriactivity

In short: The A1 certificate (also called Portable Document A1 or PD A1) confirms which country’s social security legislation applies to a person working in one or more states. Depending on the situation, it can confirm that Romanian legislation continues to apply, including in the case of a temporary posting abroad or pluriactivity. Applying a single legislation prevents overlapping contribution obligations.

Working without a valid A1 certificate creates practical risks

  • Requests for clarification from local authorities and difficulty proving which social security legislation applies.
  • Possible claims regarding registration or payment of contributions in the country where the work takes place, until the situation is clarified. Consequences vary depending on that country’s legislation.
  • Delays in starting work, or a client or contractual partner refusing access, where producing the A1 is a contractual requirement.

We check which rules apply and what documents your situation needs.

The legal basis is EU Regulation 883/2004, together with Regulation 987/2009, which sets out the practical application rules. Together they coordinate the social security systems of the EU and EEA member states, as well as Switzerland.

For the period indicated, and for as long as it has not been withdrawn or declared invalid by the issuing institution, the document confirms which social security legislation applies to the holder. Institutions in the other participating states are required to accept it, and any doubts about its validity or the data behind it are resolved through the cooperation procedure between institutions.

Who issues it and when you need it

In Romania, the A1 is issued by the National House of Public Pensions (CNPP), through the competent department. Applications are submitted according to the procedure and forms available on the CNPP portal.

The A1 does not “override” the lex loci laboris rule; it certifies the outcome of applying the European rules that determine which legislation is competent. In the case of a temporary posting under Article 12, it can confirm that an exception applies to the general rule of the country where the work is performed.

The European regulations do not set a single, automatic penalty for simply failing to produce an A1. The consequences depend on the legislation of the country where the work takes place and on whether the conditions for applying Romanian legislation are met.

The two main situations

Article 12

Temporary posting abroad

An employer that normally carries out its activity in Romania temporarily sends an employee to work on its behalf in another participating state. The direct relationship with the Romanian employer must be maintained, the person cannot be sent to replace another posted worker, and the foreseeable period cannot exceed 24 months. Continuing beyond that period can only be approved by agreement between the competent authorities under Article 16; it is not automatic.

Who this applies to:

  • Construction and assembly teams on projects abroad
  • IT or ERP consultants deployed at client sites
  • Staff travelling for short service contracts; trips for meetings, negotiations or training may also require an A1 to be assessed and applied for, even where they do not amount to transnational posting under employment law
Article 13

Pluriactivity

The person normally carries out activity, simultaneously or alternately, in two or more states. The Article 13 rules determine a single applicable social security legislation covering the whole activity, and the A1 certifies that legislation for the period established.

Who this applies to:

  • International road transport drivers who normally work across several states
  • Consultants who regularly visit clients in several member states
  • Self-employed professionals with activity split between Romania and other states
  • People carrying out employed and/or self-employed activity in several states, where the specific conditions of Article 13 are met

Other situations: distinct rules apply to civil servants, seafarers, flight crew members and certain cases covered by Article 16. These should not automatically be treated as pluriactivity.

Documents required

What the application must contain depends on the legal basis. The CNPP has simplified the procedure and mainly verifies the information and declarations included in the current form. Requirements may be updated, so the form and instructions available on the CNPP portal at the date of submission should always be used. The institution may request clarifications or additional evidence where the specific situation calls for it.

For posted employees

  • Identification details of the employer and the employee
  • The period, country and nature of the activity to be carried out abroad
  • Information on the employment relationship and the maintenance of the direct link with the Romanian employer
  • Declarations and information on the employer’s usual activity in Romania and compliance with the no-replacement condition

For pluriactivity

  • The state of residence and details of all employers or self-employed activities involved
  • The schedule and usual distribution of activity between states, including an estimate of the share of activity
  • The information needed to apply the Article 13 criteria, in line with the CNPP form corresponding to the situation

What the CNPP checks

The criteria differ depending on the legal basis. For a temporary posting under Article 12, the CNPP examines, among other things, the elements below. These do not constitute a universal list for all types of A1 application.

✓

The employment relationship

The direct relationship with the Romanian employer must be maintained. Relevant factors include responsibility for recruitment, the employment contract, payment of remuneration and the power to terminate the employment relationship. Operational coordination by the client in the host state does not automatically exclude the application of Article 12.

✓

Real activity in Romania

The employer must normally carry out substantial activity in Romania, beyond purely administrative activity. The assessment is based on several indicators, such as premises, staff, contracts and turnover, with no single indicator being decisive in every case.

✓

No replacement

The person cannot be sent to replace another posted worker performing the same activity. The condition is not limited to situations where the previous worker has reached the 24-month limit.

✓

Duration and the worker’s position

The foreseeable period must fall within the Article 12 limit, and the worker must meet the requirements on prior affiliation and the other conditions set out in the European regulations. Different criteria apply to pluriactivity, relating in particular to residence, the share of activity and the employers involved.

How long it takes

The CNPP does not publish a general guaranteed issuing deadline on its A1 page, and notes that resolving an application within a reasonable timeframe depends on whether it is complete. The general response deadline applicable to petitions addressed to public institutions should not be presented as a guaranteed A1 issuing deadline. The actual duration can vary depending on the type of application and whether clarifications are needed.

A complete application from the first submission makes the difference. Missing or inconsistent information can lead to requests for clarification, delays, or — where the legal conditions are not met — refusal to issue the document.

What the A1 does not cover

The A1 establishes which social security legislation applies. It does not replace the documents needed for access to healthcare, and it does not determine the tax treatment of income. These are assessed separately:

  • Access to healthcare (Form S1): The European Health Insurance Card gives access to necessary medical care during a temporary stay, under the conditions of that country’s public system. Form S1 is generally relevant where a person lives in one state but is insured in another, and is obtained from the competent health insurance institution.
  • Income tax: The 183-day threshold is only one of the criteria that can appear in double taxation treaties, and it does not automatically create tax residency or exclusive taxation in a given state. The period of presence, the legal and economic employer, the existence of a permanent establishment and local rules all need to be considered. In some situations, tax obligations can arise before 183 days are reached.

Frequently asked questions

How long does it take to get an A1 certificate in Romania?

The duration depends on the type of application and whether clarifications are needed. The CNPP recommends submitting a complete application, but its official A1 page does not publish a general guaranteed issuing deadline. At the assessment stage we give you an estimate based on your specific situation and the procedure applicable at that time.

What happens if I already started working abroad without one?

An application can still be submitted after the activity has started. The A1 can be issued retroactively if the legal conditions were met for that period, but issuance is not automatic. Applying as soon as possible is recommended, to limit difficulties of proof and any uncertainty with the authorities of the country where the work is performed.

Is an A1 needed for short business trips as well?

It may be. Where a trip involves carrying out professional activity temporarily in another EU or EEA state or in Switzerland, an A1 can be required, including for short trips. What matters is not the label used in the employment paperwork but the specific situation, the purpose of the trip and the activity actually carried out.

Can a company apply for A1 certificates for several employees at once?

Yes. A company can apply for A1 documents for several employees, but each document is individual, and the practical method of submission must follow the functionality and instructions of the CNPP portal in force at the time. We handle applications of this kind for companies with recurring cross-border projects.

Does the A1 cover my family if they travel with me?

No. The A1 is individual and concerns the social security legislation applicable to the worker. Family members’ rights are established separately, under the European coordination rules and the relevant documents, such as the European Health Insurance Card or Form S1, as the case may be.
